1. GENERAL PROVISIONS

1.1. This Cookie Policy is of an informational nature and sets out the rules for storing information or gaining access to information already stored in the telecommunications terminal equipment of the Service Recipient or Customer in connection with the use of the Online Store available at www.store.smseagle.eu, including the types, purposes, and legal bases for the use of Cookies, and the ways of managing them.

1.2. The entity placing information in the form of Cookies in the terminal equipment of the Service Recipient or Customer, and gaining access to information already stored in that equipment, is PROXIMUS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ [PROXIMUS LIMITED LIABILITY COMPANY], with its registered office in Poznań (registered office address and address for service: ul. 1.3. This Cookie Policy is a document separate from the Online Store's Privacy Policy. The Privacy Policy sets out the rules for processing personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as the "GDPR" or the "GDPR Regulation"), whereas this Cookie Policy sets out the rules for storing information and gaining access to information already stored in the telecommunications terminal equipment of the Service Recipient or Customer, in accordance with the Telecommunications Law Act of 16 July 2004 (Journal of Laws of 2004, No. 171, item 1800, as amended). To the extent that the use of Cookies involves the processing of personal data, the provisions of the Online Store's Privacy Policy shall additionally apply.

1.4. Any words, phrases, and acronyms appearing in this Cookie Policy and beginning with a capital letter (e.g. Seller, Service Provider, Online Store, Service Recipient, Customer) should be understood in accordance with their definitions contained in the Online Store's Terms and Conditions or in the Privacy Policy available on the Online Store's website, unless the content of this Cookie Policy indicates otherwise.

2. WHAT ARE COOKIES

2.1. Cookies are small pieces of text information in the form of text files, sent by the server and stored on the side of the person visiting the Online Store's website (e.g. on the hard drive of a computer, laptop, or on the memory card of a smartphone – depending on the device used by the visitor to the Online Store). 2.2. In addition to Cookies in the strict sense, the Controller may use, in the Online Store, similar technologies for storing information in the terminal equipment of the Service Recipient or Customer, or gaining access to such information, in particular local browser storage, web beacons (pixels), and mobile device identifiers. Whenever this Cookie Policy refers to Cookies, this should also be understood to include the similar technologies indicated above, unless the context clearly indicates otherwise.

2.3. As a rule, the use of Cookies does not cause configuration changes in the terminal equipment of the Service Recipient or Customer, or in the software installed on that equipment.

3. TYPES OF COOKIES USED IN THE ONLINE STORE

3.1. Cookies that may be sent by the Online Store's website can be divided into various types according to the following criteria:

By their provider:

1. first-party (created by the Controller's Online Store website), and
2. belonging to third parties (other than the Controller)

By storage period: 3) session cookies (stored until logging out of the Online Store or closing the web browser), and 4) persistent cookies (stored for a specified period, defined by the parameters of each file, or until manually deleted)

By purpose of use: 5) necessary (enabling the proper functioning of the Online Store's website), 6) functional/preference (enabling the Online Store's website to be adapted to the preferences of the person visiting the website), 7) analytical and performance (collecting information on the way the Online Store's website is used), 8) marketing, advertising, and social media (collecting information about the person visiting the Online Store's website in order to display advertisements to that person, personalize them, measure their effectiveness, and carry out other marketing activities, including on websites separate from the Online Store's website)

4. PURPOSES OF USING COOKIES

4.1. The Controller may process data contained in Cookies while visitors use the Online Store's website for the following specific purposes:

5. LEGAL BASIS FOR THE USE OF COOKIES

5.1. The use of Cookies necessary for the provision of an electronically supplied service requested by the Service Recipient or Customer (e.g. Cookies enabling the contents of the cart to be remembered, or the session of a logged-in Service Recipient to be maintained) does not require consent – the legal basis is Article 399(3)(2) of the Electronic Communications Law Act, pursuant to which the obligation to obtain consent does not apply where the storage of information, or gaining access to information already stored, is necessary for the provision of a telecommunications service or a service provided electronically, requested by the Service Recipient or Customer.

5.2. The use of other Cookies, in particular functional/preference, analytical and performance, and marketing, advertising, and social media Cookies, requires the prior consent of the Service Recipient or Customer – the legal basis is Article 399(3)(2) of the Electronic Communications Law Act. This consent should meet the conditions provided for by the personal data protection provisions, in particular it should be voluntary, specific, informed, and unambiguous.

5.3. Consent to the use of Cookies, as referred to in point 5.2 of the Cookie Policy, may be given using the Cookie management tool made available on the Online Store's website (if such a tool is available), or by means of the settings of the web browser or other software installed on the terminal equipment of the Service Recipient or Customer – in accordance with the rules indicated in point 6 of the Cookie Policy.

5.4. To the extent that the use of Cookies involves the processing of personal data, an additional legal basis for such processing is constituted by the relevant provisions of the GDPR Regulation indicated in the Online Store's Privacy Policy, in particular Article 6(1)(b) (agreement), Article 6(1)(a) (consent), or Article 6(1)(f) (legitimate interest of the Controller) of the GDPR Regulation.

6. MANAGING COOKIES AND WITHDRAWING CONSENT

6.1. The Controller may make available, on the Online Store's website, a tool for the easy and active management of Cookies – available upon first visiting the Online Store's website, and subsequently available in the footer of the Online Store's website. Active management allows, among other things, for checking which Cookies are or may be stored while using the Online Store's website, as well as for choosing and subsequently changing the scope and purposes of the use of Cookies in relation to the device and the person visiting the Online Store's website. When starting to use the Online Store's website, the visitor will be asked to select settings regarding Cookies. It is possible to change them later by changing the settings within this tool available on the website.

6.2. Consent to the use of Cookies may be withdrawn at any time, without affecting the lawfulness of the use of Cookies carried out on the basis of consent before its withdrawal. Consent is withdrawn by changing the settings within the Cookie management tool referred to in point 6.1 of the Cookie Policy, or by changing the settings of the web browser, in accordance with points 6.3–6.5 of the Cookie Policy.

6.3. Web browser settings regarding Cookies are relevant from the point of view of consent to the use of Cookies by the Online Store – in accordance with the provisions, such consent may also be expressed through web browser settings. As standard, most web browsers available on the market accept the storage of Cookies by default. Everyone has the option of determining the conditions for the use of Cookies through the settings of their own web browser – for example, it is possible to partially restrict (e.g. temporarily) or completely disable the ability to store Cookies.

6.4. Detailed information on changing settings regarding Cookies and deleting them independently in the most popular web browsers is available in the help section of the given web browser, and on the following pages (simply click on the given link):

6.5. It should be noted that restricting or completely disabling the storage of Cookies may affect certain functionalities of the Online Store (for example, it may become impossible to complete the Order process via the Order Form, due to Products in the cart not being remembered during subsequent steps of placing the Order).

6.6. Checking which Cookies are currently being sent by the Online Store's website is possible, regardless of the web browser, using tools available, for example, at: https://www.cookiemetrix.com or https://www.cookie-checker.com.

7. THIRD-PARTY COOKIES AND ANALYTICAL TOOLS

7.1. The Controller may use, in the Online Store, Google Analytics, GA4 services provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). These services help the Controller keep statistics and analyze traffic in the Online Store. Data collected is processed within the above services in order to generate statistics helpful in administering the Online Store and analyzing traffic in the Online Store. This data is aggregate in nature. In using the above services in the Online Store, the Controller collects data such as the sources and medium by which visitors reached the Online Store and how they behave on the Online Store's website, information about the devices and browsers from which they visit the website, the IP address and domain, geographic data, and demographic data (age, gender) and interests.

7.2. It is possible to easily block the sharing, with Google Analytics, of information about a given person's activity on the Online Store's website – for this purpose, one may, for example, install the browser add-on made available by Google Ireland Ltd., available here: https://tools.google.com/dlpage/gaoptout?hl=pl.

7.3. In connection with the possibility of the Controller using, in the Online Store, advertising and analytical services provided by Google Ireland Ltd. and Meta Platforms Ireland Ltd., the Controller indicates that full information on the rules for processing the data of visitors to the Online Store (including information stored in Cookies) by Google Ireland Ltd. is contained in the privacy policy of Google's services, available at: https://policies.google.com/technologies/partner-sites, and, with regard to Meta Platforms Ireland Ltd., in the cookie policy available on that service's website.

7.4. The Controller uses only the services of such providers of analytical and marketing tools that provide sufficient guarantees of implementing appropriate technical and organizational measures in accordance with generally applicable legal provisions.

8. FINAL PROVISIONS

8.1. The Online Store may contain links to other websites. The Controller encourages that, after moving to other websites, one become familiar with the privacy policy and cookie policy established there. This Cookie Policy applies exclusively to the Controller's Online Store.

8.2. The Controller reserves the right to make changes to this Cookie Policy, in particular due to changes in legal provisions, a change in the scope or type of Cookies or similar technologies used, the implementation of new analytical or marketing tools, or a change in the functionality of the Online Store. The amended Cookie Policy is effective from the date of its publication on the Online Store's website.

8.3. In matters not regulated in this Cookie Policy, the generally applicable provisions of Polish law shall apply, in particular the Electronic Communications Law Act of 12 July 2024, the GDPR Regulation, the Act on the Provision of Services by Electronic Means of 18 July 2002, and the Online Store's Privacy Policy.
